| RULES AND REGULATIONS 1. GENERAL INFORMATION 1.1. Owner of service with webshop and web-warehouse which Has name www.fable.com.pl is FABLE Dariusz Wojtasik, ul. Krasińskiego 25/2, 50-449 Wrocław; NIP 898-101-57-31, REGON 930661457 1.2. The person placing an order (customer), shall in the following stages of these rules and regulations be referred to as Customer, Fable is the Acceptor of the placed offer in accordance with art. 66 §1 of Polish civil code. 1. 3. Products are all goods that the Customer can purchase via the web site or fax, by placing an order on the telephone or by personally purchasing it from our premises. 1. 4. In order to place an order it is necessary to create an account by filling in the form and entering details necessary to process the order. 1. 5. By creating an account, the Customer declares the acceptance of these rules and regulations that apply to each form of placing an order. 1. 6. By registering, the Customer agrees to the personal details included in the form being processed, according to art.23, tiret 1 point 1 of the Bill on personal details protection of 29 August 1997. 1. 7. No warranty is issued for the products on Fable offer (art. 577 of the Polish civil code), unless it has been explicitly stated in a given product's description. 1. 8. If the Customer enters his e-mail address in the filled in form, that indicates the Customer's consent to receiving trade correspondence via electronic mail. 2. PLACING ORDERS 2.1. Our products can be purchased in three ways: 2.2. By placing an order via our web site at:www.fable.com.pl 2.3. By using the basket on our website. 2.4. For an order to be processed, the form must be correctly filled in by the Customer, more specifically, a contact telephone number and e-mail address must be entered, in order to facilitate contact, in case the processing of the order requires additional contact with the Customer. 2.5.. Detailed information on how to use our web site, select goods and fill in the forms is available in the sale condition folder. 2.6. By placing an order by fax on 071-327-91-13 2.7. By contacting the customer service department by telephone. The department is available at your service on workdays between 8 am and 4 pm, on: 071-327-91-13 2.8. Orders can be placed 24/7 throughout the entire year. The orders placed after 3 pm (via web site or by fax) and orders placed on Saturdays, Sundays and public holidays will be viewed on the following workday until 12 am. 2.9. If the order cannot be accepted or a product is temporarily unavailable, those making the order impossible to process, we will contact the Customer with the view of specifying further details concerning the processing of the order. 2.10. If contacting the Customer is impossible within 48 hours from receiving the order, such an order is cancelled. 2.11. An order that has been processed (i.e. the product has been dispatched) cannot be cancelled. 3. CONDITIONS OF PAYMENT FOR THE PURCHASED GOODS 3.1. The ordered products are delivered to the Customer by a forwarding company representative (UPS, SIÓDEMKA) 3.2. It is possible to commission delivery to a different forwarding company, at the Customer's request, if the Customer agrees to bear the cost of such a service. 3.3. If the goods are to be shipped by a company that is not RAW-POL's contractor, such an operation must be preceded by a pre-payment amounting to the full value or the order. 3.4. The Customer then commissions the company to collect the parcel from our premises. 3.5. The goods can be paid for by cash at delivery or with a pre-payment transferred to our bank account no 94106000760000326000950670 at BANK BPH. 3.8. If the Customer chooses to pay by cash, the dispatch or collection of the parcel takes place immediately or on the date specified by the Customer. 3.9. If the Customer chooses to make a pre-payment by transfer, the dispatch or collection of the parcel can take place after the full amount is booked on Fable’s bank account. 3.10. At the Customer's explicit wish, a pro forma invoice can be issued, on the basis of which pre-payment can be made. 3.11. The shipment cost is borne by the Customer. The fee is calculated on the basis of the weight of the ordered goods and the distance to delivery point. 3.12. In case of any additional shipment related costs, for example if the Customer does not collect the order due to lack of cash (in case of paying at delivery), or if there is nobody to collect the goods at delivery point etc.- such costs are borne by the Customer. 3.13. Together with the delivery of the ordered goods, the Customer received a VAT invoice. 4. FORM OF DELIVERY 4.1. The order is delivered to the Customer in the way specified in point 3.1 of these rules and regulations. 4.2. It is possible to deliver the goods via a different forwarding company, the rules are specified in point 3.2 above. 4.3. If the goods are to be shipped by a company that is not our contractor, the shipment must be preceded by a pre-payment amounting to the full value or the order. 4.4. For orders placed before 3 pm and where there are no obstacle, the goods will be delivered: 4.5. The next working day. If this date were to be delayed, it would be for reasons independent of Fable. For matters related to timing of the shipped parcels, please contact the local branch of the forwarding company (UPS, SIÓDEMKA) 4.6. They will be dispatched on the same day - if they are to be paid for by cash at delivery. 4.7. If the goods are to be paid for by pre-payment, the shipment takes place immediately after the full amount has come through to Fable’s bank account 4.8. The order may take longer to process if there are some sudden changes in demand (e.g. a sudden increase in orders) making it impossible to dispatch the goods on the same day the order was placed. 4.9. Our company shall not be deemed responsible for any loss occurring as a result of processing the order later than one working day after placing it. 4.10. Orders placed after 3 pm will be treated as if they were placed on the following working day. 4.11. Working days are Monday to Friday between 8 am and 4 pm, except public holidays in Poland. 4.12. If you cannot collect the parcel at any time, we kindly ask you to specify a convenient day and preferred time of collecting the parcel. 4.13. If it is impossible to deliver the goods within the time specified above, individual arrangements are made with the Customer as to when the goods are to be delivered. 4.14. If the Customer is to collect the order, the goods can be collected from our warehouse between 8 am and 4 pm from Monday to Friday, except public holidays in Poland. 5. RETURNS 5.1. Under art. 558 § 1 of civil code, the powers granted on the basis of warranty do not apply in case of contracts concluded between Fable and entrepreneurs. 5.2. Rules concerning returning undamaged goods by Customers: 5.3. The returned goods may not bear any signs of being used, must contain all the elements that were delivered with it (particularly the original packaging). The cost of shipment of returned goods is borne by the buyer. The buyer's details should be specified together with a bank account number, where the money is to be sent. 5.4. The goods that do not bear any signs of being used can be returned to us within 10 days from delivery date. 5.5. After verifying the state of the returned product, our company will return the money within 3 days to the account specified by the buyer. We do not charge any fees, only the shipment costs. 5.6. In order to receive the money back, it s necessary for the Customer to return a signed copy of the corrective invoice or receipt for the returned goods. 5.7. Goods that bear signs of being used cannot be returned. 5.8. If a Customer fails to collect goods dispatched to him, and an order has been confirmed for the goods, the Customer shall be charged with the cost of shipping the goods and returning them to our company. 5.9. The Customer is obliged to sign the corrective invoice for the goods that have not been collected and cover all cost within two days from receiving the corrective invoice. 5.10. Note relating to the purchased footwear: the following are not subject to returns: damage resulting from natural wear or using the footwear incorrectly, as well as wear and tear of the seams, stains and soiling, damage resulting from wrong maintenance; mechanical damage,damage resulting from wrongly fitted size of the footwear, comfort and creasing of the layered leather. Guidelines for maintenance: Clean the dirt with a wet cloth or sponge, dry and only then apply polish. Wet footwear requires drying in room temperature (far from heaters and radiators) for about 18 hours. Onto the surface of the lined leather apply a thin layer of cream or wax type maintenance product, preferable of the same colour as the surface. Due to the natural finish of the leather, we do not recommend using high-shine shoe polish for every day maintenance (they contain solvents that can damage the surface layer). These may be applied ocasionally. Before applying the next layer of cream, the previous one should be wiped or washed off. When the polish dries, leather should be wiped. Footwear made of suede or suede-like leather should be cleaned only with a special cloth or well wringed fabric, and spray products designed for such types of leather. After each period of work footwear should be cleaned and polished, which will ensure they last long. Footwear that is not properly maintained cannot be returned. Before commencing work, check whether the footwear is not damaged. 6. WHEN COLLECTING THE GOODS REMEMBER: 6.1. The goods should be counted in the presence of the representative of the forwarding company. If the buyer declares some missing items, a protocol should be drafted together with the representative or the buyer should immediately contact our company. 6.2. Our company shall not be deemed responsible for any missing items detected not in the presence of the forwarding company representative. 7. PRIVACY POLICY 7.1. The procedure of rendering the service for prints made directly on the clothes: - The Customer informs us while placing the order, that embroidery will be made on the products.
- Then the Customer contacts the embroidery studio in order to specify the details concerning the embroidery.
- The Customer makes a pre-payment for the goods on which embroidery will be made.
- The embroidery studio collects the products from our premises, makes the embroidery and delivers the products back to our company.
- Then the goods are dispatched.
7.2. The procedure of rendering the service for emblems: - The Customer informs us while placing the order, that embroidery will be made on the products.
- Arrangements are made as whether the emblems are to be sent with the parcel or separately.
- Then the Customer contacts the embroidery studio in order to specify the details concerning the embroidery.
- If the goods are to be dispatched without waiting for the embroidery, the dispatch is done immediately, and if the Customer decides to wait for the emblems to be ready, the dispatch is done after we have received the goods from the embroidery studio.
7.3 Payments for the embroidery services will be made separately according to the price list indicated by the service provider onto our bank account. 8. WE RESPECT YOUR PRIVACY 8.1. Any personal details that the Customer gives us while purchasing our products are processed only for the purpose of processing the order and for marketing purposes. 8.2. Fable does not use the details for any other purposes. Under no circumstances do we forward the details to third parties. 8.3. Each Customer has a right to view and edit their personal details 8.4. The sending of personal details is done via a safe protocol SSL 128 (Secure Socket Layer v3). It is a protective device that codes data while sending it both to the web site Customer and back. Therefore no third party can view your personal details. 8.5. The Customer has a right to demand deleting their personal details from Fable 's database. Such demand should be presented in writing. 9. FINAL ARRANGEMENTS 9.1. The seller reserves the right to withdraw certain products from its offer. 9.2. The prices of the products on offer are expressed in the currency selected by the Customer from the following currencies (PLN ). For the presented products a net price has been specified. while viewing he order (basket), the appropriate VAT rate has been added. 9.3. The presented prices are aimed at customers dealing with the distribution of PPE (wholesalers). The prices for companies and persons who are end users of the ordered products (retailers) are specified at www.reis.pl. Below we present the rules for quoting prices: 9.5. The photographs of products displayed on our web site may differ slightly in appearance and colour from the actual products. 9.6. These rules and regulations are the only document specifying the procedures and rules for placing orders. 9.7. The seller reserves the right to alter the contents of the rules and regulations. Each Customer is obliged to become conversant with the contents of these rules and regulations and is boundby their provisions. 9.8. We shall not be deemed responsible for any loss related to faults in the operation of the web site, nor for losses resulting from the use of details and information included therein. 9.9. The enclosed price list does not constitute an offer under civil law. 9.10.
